First, distinguish the closed subclass from live legacy obligations

The Business Innovation and Investment Program (BIIP) permanently closed to new subclass 188 applications on 31 July 2024. This means a new potential entrepreneur or investor should not be invited to lodge a fresh subclass 188 application in the historical Business Innovation, Investor, Significant Investor or Entrepreneur streams. Some streams had separate earlier closure dates; historical claims must therefore specify the exact stream and period.

Closure to new applicants does not mean that every earlier visa application, granted visa or existing right has ceased. The Department states it continues to process qualifying applications lodged before the closure date. It separately offers a specified refund process for some applicants who choose to withdraw. This page therefore serves people who are already part of the historical system—not prospective applicants seeking a now-closed investment migration product.

Subclass 888 is a distinct permanent visa, not simply a continuation of an open 188 recruitment program. The Department still publishes subclass 888 eligibility guidance for qualifying provisional visa holders and particular historical holders of other visas. Each stream carries its own evidence requirements and qualifications. Do not assume all 188 holders automatically become 888-eligible.

What the former subclass 188 programs were

Business Innovation historically focused on operating or establishing a business under relevant nomination, assets and business activity requirements. Investor and Significant Investor streams historically dealt with qualifying investment structures and their maintenance. Entrepreneur addressed nominated entrepreneurial activity and prescribed criteria. Extension streams were intended for certain existing visa holders. These descriptions help identify a person’s existing legal position; they are not advice to initiate a new 188 application.

The Premium Investor pathway had a distinct program history and its closure timing should not be collapsed into the general 31 July 2024 BIIP statement. Source-based stream-by-stream historical records should be preserved within an archival reference, if an audience still needs them.

The original nomination, invitation and visa grant dates matter. The applicable legal thresholds, residence periods and investment rules can differ between cohorts and streams. Do not rewrite a 2021-granted visa holder’s obligations using requirements issued for a later program structure.

What happens to applications lodged before closure

Home Affairs states that valid applications made before closure may continue to be processed according to planning levels and processing priorities. Applicants should rely on ImmiAccount correspondence, requests for further information and official status communications. Closure does not itself amount to an automatic refusal, grant or refund.

People awaiting decisions should preserve nomination correspondence, documentary evidence, contact details and any required updates concerning passports, family status, business circumstances and investment arrangements. Some changes should be notified through ImmiAccount or appropriate departmental forms. Failure to maintain information can cause separate processing problems even when an application was initially valid.

The decision to continue or withdraw can have serious consequences. An applicant physically in Australia may rely on an associated bridging visa or have other immigration dependencies. Before any withdrawal, establish what happens to lawful status, work rights, family members, travel conditions and alternative applications.

Refund eligibility and the withdrawal workflow

The Department describes a refund option where specified subclass 188 applicants withdraw their pending application on or after 31 July 2024. It identifies Business Innovation, Investor, Significant Investor and Entrepreneur as potentially eligible refund streams. Business Innovation Extension and Significant Investor Extension are expressly not included in that specified refund program. Different refund provisions may exist under other authorities, so individual entitlement cannot be assumed.

According to the government instructions, first submit a withdrawal through ImmiAccount. Once formal withdrawal notification is received, request a Visa Application Charge refund through ImmiAccount’s My Payments, Manage Payments and Request Refund facilities, selecting the applicable BIIP voluntary withdrawal reason. The Department does not publish a standard refund processing timeframe.

A refund is not a free option that should automatically be recommended. The immigration consequences of withdrawal may substantially outweigh its financial value for an applicant whose current status depends on a pending application. This page should link to the Department’s withdrawal guidance and direct readers toward appropriately authorised individual assistance where needed.

Understanding subclass 888 eligibility

The Business Innovation and Investment (Permanent) visa, subclass 888, covers a set of stream-specific permanent residence pathways intended for eligible people who have held qualifying provisional visas or, in certain cases, particular historical visas. Official published stream information should determine eligibility—not generic claims about investment volume or years in Australia.

In the Business Innovation stream, Home Affairs describes eligibility for relevant 188 Business Innovation or Extension holders and certain subclass 444 or historical subclass 457 holders. The Entrepreneur stream generally concerns qualifying 188 Entrepreneur visa holders who have undertaken entrepreneurial activity and meet nominated success, residence and other criteria. Investor, Significant Investor and other streams address relevant qualifying investment and residence histories.

Each prospective 888 application may need business operations, ownership, revenue, employee, asset, residence, investment maintenance, state nomination, compliance and tax evidence, depending on the stream and historical rules. The fact that a 188 visa was granted does not establish that every subsequent 888 condition has been met.

Permanent residence rights arise only if a subclass 888 application is granted. A provisional visa remains governed by its own validity period and conditions, and applicants should plan well ahead of expiry.

Three different starting situations

Scenario A — not previously an 188 applicant: the program is closed and should not be advertised as a new migration route. Depending on the person’s individual achievements or skills, wholly different visa categories might merit separate research, but none is a legal direct replacement for 188.

Scenario B — a pending subclass 188 application: confirm whether the application was validly lodged before closure, then evaluate the implications of continuing, responding to Department requests, or withdrawing and requesting a refund. Do not make an irreversible withdrawal based on a marketing webpage.

Scenario C — an existing subclass 188 holder: identify stream, grant date, obligations, business or investment evidence, nomination requirements and whether a subclass 888 application could be viable. The person may have a highly individual timeline and should use the official stream rules applicable to their cohort.

Practical records to preserve

Pending 188 applicants should retain complete application copies, payment receipts, nomination and invitation records, correspondence, business or investment evidence, translated documents and records supporting any changes reported to Home Affairs. Keep a dated account of official communication rather than relying on oral assurances.

Provisional visa holders exploring subclass 888 should maintain business registration and ownership evidence, financial statements and tax returns, investment confirmations and statements, employment records, residence records, nomination letters and detailed evidence of compliance with individual grant conditions where applicable. Different streams require different proof; this is a preparation framework and not an exhaustive statutory checklist.

Original evidence should be consistent across corporate registrations, banking records, financial reporting, tax material and immigration applications. Inconsistencies need accurate explanation and supporting documentation, not cosmetic editing.

Why subclass 858 is not a like-for-like replacement

National Innovation subclass 858 is invitation-only and directed at internationally recognised exceptional and outstanding achievement. It is not a new investor migration category with a direct investment threshold replacing the former Significant Investor visa.

Employer-sponsored, points-tested and regional pathways also serve different purposes and contain different eligibility criteria. An entrepreneur, investor or business owner should not be told that a different category is automatically available because BIIP closed. Responsible navigation offers informational comparisons and independently assesses each pathway’s own criteria.

For SEO, the optimal permanent architecture is one authoritative 188 closure and transition page, a separate substantive 888 page, and a distinct current NIV/858 page, with carefully written contextual links. Do not retain five marketing landing pages describing closed 188 streams as available new-application choices.

Frequently asked questions

Can I submit a new subclass 188 Business Innovation application?

No. The BIIP subclass 188 program is closed to new applications, with historic stream-specific distinctions.

Are previously lodged 188 applications automatically rejected?

No. Home Affairs says applications lodged before the closure date continue to be processed.

Does every applicant receive a refund?

No. The published refund program has stream and withdrawal criteria; it is not universal.

Which streams are excluded from the announced refund option?

Home Affairs lists Business Innovation Extension and Significant Investor Extension as excluded from that specified refund arrangement.

How do I request the announced refund?

Follow Home Affairs withdrawal and ImmiAccount payment/refund instructions; assess visa status implications before withdrawing.

Is subclass 888 closed because subclass 188 closed?

No. The subclass 888 permanent visa remains relevant to eligible qualifying applicants.

Does a subclass 188 grant guarantee subclass 888?

No. A separate permanent application must satisfy the relevant stream criteria.

Can I switch my historical stream freely?

No. Rules depend on the person’s specific grant, nomination, stream and visa conditions.

Is National Innovation a replacement investor visa?

No. NIV is an exceptional-achievement, invitation-only permanent visa, not a like-for-like BIIP successor.

What should a current 188 holder do first?

Check their grant letter, stream, expiry date and official subclass 888 stream criteria, while preserving documentary evidence.

Closure is not the same as cancellation of existing rights

The Business Innovation and Investment Program closed to new subclass 188 applications on 31 July 2024. Applications validly lodged before closure may still be processed under relevant laws and processing priorities; closure does not imply that all current applicants or visa holders lost their existing pathway.

Existing subclass 188 holders: Some may qualify to apply for a permanent subclass 888 visa if they satisfy the precise stream requirements. The official policy record also identifies extension routes for eligible Business Innovation and Significant Investor holders; the availability of an extension should be checked for the individual’s stream and circumstances rather than offered universally.

Not every subclass 888 applicant must hold subclass 188. Under its Business Innovation stream, certain eligible subclass 444 holders and certain historical subclass 457 holders are also identified in the official subclass 888 guidance. This is a narrow, rule-specific exception and must not be described as automatic eligibility for all holders of those visas.

Refunds and withdrawal: The Department identifies Visa Application Charge refunds for qualifying subclass 188 applicants who withdraw their applications on or after 31 July 2024. The specified refund streams are Business Innovation, Investor, Significant Investor and Entrepreneur. Home Affairs explicitly excludes Business Innovation Extension and Significant Investor Extension from this closure-specific refund arrangement. Eligibility, formal withdrawal and refund requests are separate procedural steps; withdrawing while in Australia can affect a person’s current visa status. Check the official guidance before submitting a withdrawal. The refund process, procedural requirements and whether a visa application should be withdrawn must be assessed separately before taking irreversible action.

188 closure and 888 transitions: preserving legacy eligibility

The Business Innovation and Investment Program closed to new subclass 188 applications on 31 July 2024. Applicants who validly applied before closure may remain within the former programme’s transitional processing arrangements. Closure does not mean that every existing 188 holder lost access to all 888 permanent pathways.

For a holder of an existing or former 188 visa, begin with the original invitation date, stream, grant history, nomination, visa conditions and substantive business or investment evidence. The subclass 888 criteria are stream-specific and some Business Innovation applicants need to evidence continuous management, business ownership, turnover and physical presence.

Home Affairs identifies a closure-related application charge refund arrangement for qualifying withdrawn applications in the Business Innovation, Investor, Significant Investor and Entrepreneur streams. That special refund arrangement does not automatically extend to the two extension streams. A withdrawal can have immigration-status consequences and should not be initiated solely to seek a refund without appropriate advice.

Some subclass 444 holders and certain historically eligible subclass 457 holders may also qualify under the 888 Business Innovation stream. Those are defined exceptions, not an instruction to all 444 or 457 holders to submit an 888 application.

Legacy BIIP cases: reconstruct the application before deciding its future

Identify which legal cohort the applicant belongs to

The Business Innovation and Investment Program stopped accepting new subclass 188 applications on 31 July 2024, but the date of closure is not the date on which every existing interest vanished. An applicant who submitted a valid application before the closure, a person already granted subclass 188, a previous applicant considering withdrawal, and a subclass 888 candidate each have different issues. Record the stream, original application date, invitation date if relevant, application or grant reference, sponsoring state or territory, remaining visa validity and all subsequent decisions. An adviser cannot reliably classify a case by the label ‘BIIP’ alone.

For an undecided old application, separate the probability and timing of processing from legal eligibility. The Department says valid applications lodged before closure continue to be processed. There is no guarantee of grant or a particular timeframe. An applicant should preserve access to their ImmiAccount, keep contact and family information correct and retain evidence submitted earlier. If a business or investment changed after lodgement, check whether the Department must be notified rather than assuming the historical evidence still describes the case.

Withdrawal and fee refunds are two distinct decisions

The Department’s closure guidance identifies an application-charge refund arrangement for qualifying applications withdrawn on or after 31 July 2024 from the Business Innovation, Investor, Significant Investor and Entrepreneur streams. The Business Innovation Extension and Significant Investor Extension streams are outside this particular closure-linked refund arrangement. A visa application may be withdrawn without a refund, and a refund entitlement is not necessarily established just because a refund form was sent. Review the specific stream and instructions currently in force.

More importantly, withdrawal can affect lawful status and future options, particularly for an applicant in Australia holding a bridging visa related to the pending application. Before withdrawing, record the person’s present substantive or bridging visa, travel plans, any no-further-stay or other conditions, family-member applications and deadlines. A cost recovery decision should never inadvertently become an unlawful-stay problem. Keep a copy of the withdrawal confirmation and the separate refund determination if a refund is requested.

Map possible 888 eligibility without promising progression

Where subclass 188 was granted, the next task is to identify the exact permanent stream and the conditions of the provisional grant. Business Innovation evidence may concern ownership, management, Australian business operations, annual turnover, state nomination and other statutory conditions. An Investor or Significant Investor pathway turns on different qualifying investment records, maintenance requirements and nomination arrangements. Entrepreneur-related cases need evidence of the relevant approved activity and any stream-specific achievements. Do not interchange a business owner’s accounts and an investor’s complying-investment documentation.

The subclass 888 Business Innovation stream has narrow alternative starting points beyond recent subclass 188 grants, including certain subclass 444 and historical subclass 457 holders. Those cases have their own statutory eligibility history, and the exception does not extend automatically to every 888 stream. The current visa status and the dates on which the necessary visa was held must be verified before suggesting permanent eligibility. In particular, do not describe the closed subclass 188 as an active entry route for a new offshore investor.

A defensible records archive

The strongest BIIP archives are indexed chronologically rather than organised around the latest marketing brochure. Retain all invitation and nomination correspondence; original visa notices and conditions; business registration and ASIC extracts; share acquisition records; audited accounts; BAS and ATO documents; evidence of management activity; official investment subscriptions and redemptions; bank documents proving the origin and movement of funds; and records of all material business or family changes. Originals, certified translations and evidence of the date of issue should remain distinguishable.

Create a source-and-date log for each financial assertion. ‘We invested five million dollars’ and ‘we maintained complying significant investments for the statutory period’ are not equivalent claims. Likewise, gross turnover and qualifying personal or business assets are different metrics. Record the calculation period, entities involved, exchange-rate treatment where relevant and supporting evidence for each amount. Where a business group is complicated, independent Australian accounting and migration-law advice may both be needed.

Decision paths that should stay separate

  • Still pending: verify that the application was validly lodged before closure and maintain truthful, current evidence.
  • Granted subclass 188: audit its stream, expiry, extensions where legally available and a specific subclass 888 evidence plan.
  • Considering withdrawal: conduct a lawful-status and family-visa impact review before any irreversible action.
  • No existing BIIP history: evaluate genuinely available current categories; a 858 invitation is not an investor visa purchased by meeting a capital minimum.
